Claims Against Your Insurance Company

Attorneys Helping Injured People Get Fully Compensated

If you have been injured in a car accident, you may have a claim against the other driver's insurance company, but you may also have a claim against your own insurance company if it is not providing you with the benefits you legally deserve.

At the law firm of Carman & Bevington in Brandon, Florida, we help clients seek maximum compensation by pursuing insurance claims against their own carriers when necessary. Contact us for a free consultation — we serve the Tampa Bay area. You will not pay anything unless you get compensated.

Understanding Florida Auto Insurance Benefits

Your own insurance company may be required to pay you benefits for injuries suffered in a motor vehicle accident. Watch our video with Allen Carman and Vanessa Bevington discussing insurance coverage. The following coverage options provide specific types of benefits to injured policy holders.

  • Uninsured and underinsured motorist (UM) coverage: This coverage will provide you with personal injury benefits if you are injured by a driver without insurance, a driver without enough insurance to cover your damages, or a hit-and-run driver. In Florida, your auto insurance policy must include this coverage unless you specifically waive it.
  • Personal injury protection (PIP) coverage: If you are injured in an auto accident, this coverage will pay your medical bills, lost wages and some other expenses associated with your injuries, no matter who caused your accident. Florida is a no-fault state, which means that PIP coverage is mandatory for cars and trucks.
  • Medical payments (MedPay) coverage: This is an optional coverage that will pay your medical bills above and beyond your PIP limits no matter who was at fault for your injuries. MedPay does not cover lost wages or other non-medical benefits, so getting the most out of all of your coverage categories can become complex.

Pursuing the Benefits You Legally Deserve

Your insurance policy is a contract between you and your insurance company, and if they do not live up to their end of the bargain, you may have a breach of contract claim against them.

It may also be possible for you to bring a claim against your insurance company based on Florida insurance law. For instance, if you signed a waiver of UM coverage without informed consent, it may be possible to sue on that basis.
